Terms Of Service
General Terms of Service
· Private commissions: I do not work with private commissions at this time due to limited availability. You can request to remain anonymous if you’d like, but your order may be posted to any of my public galleries.· Posting your commissioned art: Of course! You may post your commissioned artwork yourself, all that I ask is that you credit me for the work.· Editing commissioned art: I would prefer no edits be made to my artwork as I’m usually more than happy to perform the edits myself assuming they’re small tweaks. If you do decide to go against my wishes and edit the artwork I ask that you either clear it with me prior to posting or make it very clear on the post that the edits were done by you and not me.· Refunds: Refunds can NOT be offered once work has been started. Depending on the urgency of the situation and the amount of work that has been done I may be willing to offer a Prorated refund. This is at my discretion.
Regarding References:
· SFW is preferred, but I do not mind if your reference sheet is mildly NSFW. (Artistic Nudity, Non erect etc.)· Please provide your reference material in the forms where it is requested. I may not accept your commission application if a reference isn’t provided. “I will send it via email/DM” is not acceptable.

Twitch Streams:
· You can always request your badge be done over stream! I may not always be available to do so at the times you are available to watch, but I usually enjoy streaming my work and chatting with the community! Please keep in mind this is a -Request- And not a guarantee that I will stream your badge.· You can follow my Twitch at Twitch.tv/PhaseCaldera
Deadlines:
· If you need your badge by a certain date, I need to know before I begin work on your commission!· Please give me ample time heads up to fulfill your request. Some deadlines will not be possible if given too short of a notice as the work and shipping process can sometimes be lengthy.· Out of respect for others on my queue, I have to make sure your deadline doesn't push back other orders. We will discuss if the date is doable!· Arrangements for a Rush Fee can be made under certain circumstances. Rush Fee's will be discussed on a case by case basis but are not cheap.· Flexibility when discussing deadlines is appreciated. There are many factors involved in this work process.· If you ever have any concerns or questions at all, You can always reach me via email. I will respond to you within a 24-48 hour window.
Rights & Usage:
Your rights:· You can print the artwork. You are more than welcome to print for personal use. You can turn the art into a badge, add your character's name, etc!· You can make stickers, buttons, anything as long as they are NOT intended to be sold or used to promote your business. My art isn't to be used for profit, promotions, advertisements, or anything of the sort unless discussed beforehand. Fees may apply.· You can add your own personal watermarks to the image to prevent theft as long as it is made clear that the artwork is done by me.· You can post your commissioned artwork to websites/personal character galleries, use it as your icon, banners, etc. Just please credit me somehow!My rights:· I may use the artwork in personal portfolios, advertisements, on my website, etc.· I reserve the right to post your commissioned work to any of my public galleries. I do not work with private commissions at this time.· I will not sell your commissioned piece as prints or reproduce as merch. Unless being created FOR the Commissioner as an add-on service.· I may or may not post your commissioned piece to my online galleries. If I don't post the art, it doesn't mean that I don't like it!· I do not always credit the client in personal ads or promotions. However, I will always credit the owner when the image is posted individually.· I reserve the right to refuse a commission for any reason.· I reserve the right to terminate a commission due to rude, hostile or inappropriate behavior including but not limited to the expectations highlighted on my Terms of Service. I strive to provide a calm and respectful environment with my commissioners and expect the same in return. Verbal, Physical or Mental abuse of my staff or myself will not be tolerated and may result in the partial or full cancellation of your commission order. Full refunds for cancellations handled in this way may result in a partial or no refund at all depending on the amount of work done.
Buyer Responsibilities:
When filling out commission forms:· You must have your character(s) and information ready to provide upfront. I select commissions based on the information provided in the form. You are allowed to request edits in the sketch, however you cannot request to change the character or any major details (background, theme, etc) of your commission once you have paid for your order.Requesting edits on commission orders:· All revisions must be requested in the appropriate update window. Any revisions outside this window are subject to additional charges and fees.(For example: Requests to edit line-art during the sketch and Ink update are perfectly acceptable while a request to edit the line-art during the flat color, shading or final check in would result in additional fees.)· If I feel there have been too many requested edits, I will let you know that I will need to start charging for further edits.
Prohibited Content:
I WILL NOT draw the following content:· Most NSFW themes at this time. Mildly suggestive themes are okay. Artistic nudity is generally okay.· Words or themes that are known to be offensive. This heavily applies to slurs.· Cultural appropriative content. This is a subject I am still learning about. I will not knowingly accept requests that I know/feel are appropriative in nature.· Please ask me if you’re unsure about a certain topic.
Payment & Billing
· Payment is requested via PayPal invoice. Please pay the invoice within a 48-hour window unless discussed otherwise.· Failure to pay the invoice within 48 hours will result in an invoice cancellation and the slot reposted.· If you can't make a payment due to unforeseen circumstances, please let me know. It is perfectly understandable as long as you communicate this with me. Otherwise, it is unlikely I will agree to work with you again due to lack of communication.
Shipping:
(Traditional and Physical Deliveries)Shipping fees cover shipping and handling.
US shipping: $10
International shipping: $15· Once the order is shipped, it is out of my hands. I have no control over how long it could take to arrive at your destination. If you have not received your order in a timely manner, I will happily provide a scan via email.· Shipping delays may occur depending on your location. We exist in a living world with any number of variables. Pandemics, Ships stuck in canals, wars etc. Because of this I cannot guarantee timely delivery.· If you live within the continental US: Please allow at least a month for the item to arrive. I can provide you with a tracking number at your request so that you can track its progress.· If you live outside of the continental US: Tracking is not available for international orders. Please allow 5-6 months for the item to arrive once it has been shipped. Yes, that is a long time, unfortunately this is an estimate based on multiple previous experiences.
